Terms of Service

These terms of service ("Terms") govern your use of the website at activepg.com and the associated coaching platform (collectively, the "Service") operated by Active Performance Group Inc. ("we," "us" or "our"). By accessing or using the Service, you agree to be bound by these Terms.
1. Description of Service
Active Performance Group provides performance coaching services, including nutrition coaching, training coaching and supplement guidance. The Service includes a website, client portal, appointment scheduling and related tools. Supplement plans are offered in partnership with Peptide Restore and are subject to Peptide Restore's own terms and policies where applicable.
2. Eligibility
You must be at least 18 years old to create an account and purchase a coaching plan. Youth athlete coaching plans require enrollment by a parent or legal guardian.
3. Accounts
You are responsible for maintaining the security of your account credentials, including the phone number used for authentication. You agree to provide accurate and complete information during registration and onboarding. You are responsible for all activity that occurs under your account.
4. Coaching Services Disclaimer
The Service is not medical advice. Our coaches are not licensed physicians, and the coaching, guidance and information provided through the Service are for general wellness and performance purposes only. The Service is not a substitute for professional medical advice, diagnosis or treatment. Always consult a qualified health care provider before starting any new supplement, nutrition or exercise program.
Blood work panels and other health-related documents you upload are used solely for coaching purposes. We are not a health care provider, and the Service is not HIPAA compliant. By uploading health-related documents, you acknowledge and accept this limitation.
5. Subscriptions and Payments
Coaching plans are offered as monthly subscriptions. Payment is collected through Stripe at the end of the onboarding process, before your first scheduled coaching session. Subscriptions renew automatically each month unless canceled.
Supplement subscriptions, where applicable, are created by your coach and require your confirmation before the first order is placed. Supplement pricing is determined by Peptide Restore and may be subject to change.
6. Cancellation and Refunds
You may cancel your coaching subscription at any time through your account portal or by contacting us directly. Cancellation takes effect at the end of the current billing period. We do not provide prorated refunds for partial billing periods.
Supplement subscription cancellations are handled separately and may be subject to Peptide Restore's cancellation policies.
7. Scheduling and Appointments
Recurring weekly coaching sessions are scheduled during onboarding based on coach availability. You may change the day or time of your recurring session through the client portal, subject to coach availability. Appointment confirmations and reminders are sent via SMS to the phone number on your account.
8. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose
- Provide false or misleading information during registration or onboarding
- Attempt to gain unauthorized access to any part of the Service
- Interfere with or disrupt the Service or its infrastructure
- Resell, redistribute or commercially exploit any part of the Service without our written consent
9. Intellectual Property
All content, design, graphics, trademarks and other intellectual property associated with the Service are owned by Active Performance Group Inc. or its licensors. You may not copy, modify, distribute or create derivative works from any part of the Service without our prior written consent.
10. Third-Party Services
The Service integrates with third-party services including Google (for calendar and video meeting functionality), Stripe (for payment processing) and Peptide Restore (for supplement fulfillment). Your use of these services is subject to their respective terms and privacy policies. We are not responsible for the practices or availability of third-party services.
11. Limitation of Liability
To the fullest extent permitted by law, Active Performance Group Inc. and its officers, directors, employees and agents shall not be liable for any indirect, incidental, special, consequential or punitive damages arising from your use of the Service. Our total liability for any claim related to the Service shall not exceed the amount you paid to us in the 12 months preceding the claim.
12. Indemnification
You agree to indemnify and hold harmless Active Performance Group Inc. from any claims, damages, losses or expenses (including reasonable attorney fees) arising from your use of the Service, your violation of these Terms or your violation of any rights of a third party.
13. Changes to These Terms
We may update these Terms from time to time. If we make material changes, we will notify you by posting the updated Terms on this page with a revised effective date. Your continued use of the Service after changes are posted constitutes acceptance of the updated Terms.
14. Governing Law
These Terms are governed by the laws of the state in which Active Performance Group Inc. is incorporated, without regard to conflict of law principles.
